Criminal liability Minimum wage Wage manipulation, non-payment or withholding of wages

Under this Article, any businessman, intermediary or workshop owner, who uses violence, intimidation, handouts or false promises, in order to pay salaries below the minimum wage prescribed by the law, may be punished with 6 months to 2 years of imprisonment.

Law No. 12,713 is aimed at protecting the rights of individuals who perform works for third parties from a domicile (i.e., home-based work, or work performed at the domicile or premises of the owner of a workshop, among others).
